Intellectual Property as a Strategic Asset of the Cultural Media Center

More than 2000 titles of cultural media content have been produced by the Cultural Media Center. Various types of media content ranging from short films, documentaries, film series, cultural coverage to animated films have intellectual property rights that need to be managed according to the rules in accordance with the applicable intellectual property laws and regulations.
Inviting various related parties, Mr. M. Asrian Mirza, S.S., M.M., Special Staff to the Minister for Media and Public Communication, (Ministry of Culture), Directorate of Copyright and Industrial Design, DJKI, (Ministry of Law of the Republic of Indonesia), Legal Bureau and Cooperation Bureau and Public Relations and Information Bureau (Ministry of Culture), Directorate of Cultural Value Empowerment and Intellectual Property Facilitation, as well as the Secretariat of the Directorate General of Development, Utilization, and Cultural Guidance, the Cultural Media Center held a Meeting on Registration and Management of Intellectual Property Rights held in Room M1 Harris FX Sudirman on Wednesday, October 29, 2025.
In the meeting, Mrs. Ardhien Nissa Widhawati Siswojo, S.H., L.LM., Head of the Legal Bureau and Cooperation Facilitation, Ministry of Culture explained that Intellectual Property is an exclusive right that arises from human ability to create, innovate, and create. Intellectual Property has various types, namely: patents, trademarks, industrial designs, copyrights, geographical indications, trade secrets, and layout designs of integrated circuits, with two types of ownership, namely communal and personal intellectual property. Cultural Advancement Objects (OPK) that are recorded as traditional heritage without a single creator are considered communal intellectual property, as well as a creation that is the result of a creator's work has Copyright protected by Law Number 28 of 2014 concerning Copyright and can be registered in the intellectual property database of the Directorate of Copyright and Industrial Design, Ministry of Law of the Republic of Indonesia.

Another interesting discussion in the discussion regarding the ownership status of Copyright over a work of the Cultural Media Center film episode created by filmmakers with funding and supervision from the Cultural Media Center, was emphasized by the resource person, Junior Legal Analyst, Achmad Iqbal Taufiq, S.H., M.H. from the Directorate of Copyright and Industrial Design, Ministry of Law of the Republic of Indonesia, that in Article 33 Paragraph 1, Law Number 28 of 2014 concerning Copyright states that "In the event that a Creation consists of several separate parts created by 2 (two) or more Persons, the one considered as the Creator is the Person who leads and supervises the completion of the entire Creation." Then in Paragraph 2 it is explained that if there is no Person who leads and supervises the completion of the entire Creation as referred to in paragraph (1), the one considered as the Creator is the Person who compiles the Creation without reducing the Copyright of each on their respective parts of the Creation.

For various types of cultural objects and expressions from Sabang to Merauke, both owned by the communal indigenous communities in the regions and personal ownership, the state is present through the Directorate of Cultural Value Empowerment and Intellectual Property Facilitation (Dit. PNBFKI), Ministry of Culture to facilitate the process of registering Intellectual Property through the portal https://fasilitasi.id/hakcipta/ managed by Dit. PNBFKI by filling out forms and completing supporting data and documents, said Herry P. Manurrung (member of the Intellectual Property Facilitation Subdirectorate team, Dit. PNBFKI). In the future, the commitment and efforts to manage and enforce Cultural Intellectual Property Rights need to be continuously upheld so that all creators, inventors, and intellectual property rights holders are guaranteed and protected in their rights and are prevented from misuse that could cause losses to various parties.
